① Basic Overview and Composition:
The Ministry of Forestry is the forest resources authority established after the split of the former KLHK. It is responsible for forest areas, protected forests, production forests, forest land use, forestry permits, forest ecology, and forest resource conservation. Unlike the Ministry of Environment, its focus is not on emissions and environmental impact assessments, but on whether land falls within forest areas, whether forest land can be used, and forest resource protection.
② Role and Operation:
The Ministry of Forestry manages forest area designation, forest land use, area conversion, ecological compensation, forestry permits, forest resource utilization, and protection. If a company's project site overlaps with a forest area, even if a land contract has been signed or local support obtained, it may still need to go through forest land use, area adjustment, or related approvals; otherwise, the project cannot be legally constructed.
③ Uses and Relevance for Chinese-invested Enterprises:
For Chinese-invested mining, industrial parks, roads, ports, power lines, plantations, real estate, and infrastructure projects, forest land attributes are a very high-risk pre-check item. Before acquiring a mine or land, enterprises should verify whether the land falls within protected forests, production forests, or other forest areas to avoid risks such as land being tradable but not developable, project approvals being stalled for a long time, or later being deemed illegal occupation of forest land.
